Is TikTok about to get banned in the US? It’s now up to the Supreme Court

TikTok has no way to avoid its The impending ban in the United States. But one of TikTok’s only hopes has just emerged. The U.S. Supreme Court has agreed to hear TikTok’s arguments against an impending ban. Here are the details.

The U.S. Supreme Court will hear TikTok’s challenge on January 10

TikTok could soon be banned in the United States unless ByteDance sells its U.S. stake in the social app, under legislation passed by the U.S. Congress and signed by President Joe Biden.

So far, all ByteDance’s challenges have failed.

But there is one legal way to avoid the impending ban: the U.S. Supreme Court.

Today, the Supreme Court formally agreed hear the case Friday, January 10, 2025.

TikTok and its legal opponents will have a total of two hours of oral arguments.

Both sides still have several deadlines to meet ahead of schedule.

According to the Supreme Court Memorandum:

The parties shall electronically submit their opening briefs (limited to 13,000 words) and joint appendices simultaneously on or before Friday, December 27, 2024 at 5:00 p.m. ET. By 5pm ET on Friday the 3rd.

The Jan. 10 hearing date doesn’t provide much of a buffer before the Jan. 19 deadline.

It’s possible the Supreme Court could expedite a decision after the Jan. 10 hearing, but it would still be unusual for a decision to come down almost immediately.

Another factor in this discussion is President-elect Donald Trump, who indicated If possible, he might try to reverse the ban. He will take office the day after the January 19 deadline.

Regardless, the Supreme Court’s intervention is good news for TikTok and parent company ByteDance. This means there is still hope for their legal action.
